Police Don’t Have To Knock

In a 5-4 decision, the United States Supreme court ruled that the police do not have to knock nor do they have to wait a reasonable amount of time before entering a residence. Predictably, both of Bush’s cout appointees sided with the majority decision claiming that putting such limitaitons on the police would result in a flood of appeals from convicts. This decision is very indicative of the surrender of power that is consistent of the post 9/11 “United” States.

“It weakens, perhaps destroys, much of the practical value of the Constitution’s knock-and-announce protection,” concluded Breyer, who said he fears police will now feel free to routinely violate the knocking and waiting requirements, knowing they might not be punished for it.
